Our partner, the KE-booking service, is managed by KAMYAB-editions, 33 rue du maquis de Chambarand, 38210 Tullins – France, registered number 537 515 082 with the Grenoble Trade and Companies Register. Its general terms and conditions of sale apply to the reservation and purchase of services related to travel and tourism and to all services available directly or indirectly online, by e-mail or by telephone.
Use of the booking area
The user must be at least 18 years old, be legally capable of entering into a contract and use the site in accordance with the General Terms and Conditions of Sale. The user is financially responsible for his or her actions, except in the case of fraud for which he or she must provide proof, and also guarantees the truthfulness and accuracy of the information concerning him or her provided in the booking area made available to him or her.
Booking and purchasing services
After choosing the services and completing the identification form, the user must read and validate the special conditions of the service provider(s) associated with these general terms and conditions of sale. The user will receive an e-mail confirming the order, which will include the essential elements such as the identification of the service(s) ordered and the price.
Cancellation of orders
Cancellation conditions can be accessed directly on the booking space beforehand in the General Terms and Conditions of Sale and are mentioned on the order confirmation. KE-booking collects cancellations in the name and on behalf of the service providers concerned. Any cancellation must follow the following procedure: in your confirmation email, you can click on a link allowing you to request cancellation of your holiday. You may be liable to pay an amount corresponding to a percentage of your stay in accordance with the specific conditions of the service provider indicated above. For all cancellation requests, the date used to calculate the charges will be the date on which the cancellation form is completed or the date on which your e-mail is sent. If the cancellation is not forwarded to our services, the cancellation fee will be that of the no-show indicated by the service provider above. KE-booking reserves the right to cancel any order that is abnormal in price or composition. KE-booking will inform the customer as soon as possible and reimburse the sums paid at the time of booking. When a reservation is made, the service provider, in the event of being unable to honour the service reserved, has the option of cancelling the reservation until 12:00 on the day following the reservation date. In this case, the full amount paid will be credited back to the card used to confirm the booking.
Travel documents
The holiday documents issued for a service ordered via the KE-booking space are sent to the email address given by the user when the order was placed. The email summarises all the information concerning the stay (room booked, number of people, price, etc.) as well as the contact details of the service provider. If it is impossible to send the order confirmation email due to an error by the user in entering their details, neither the service provider(s) concerned nor KE-booking will be held responsible. Proof
It is expressly agreed that, unless there is an obvious error on the part of the service provider(s) or KE-booking for which the user can provide proof, the data kept on the KE-booking platform and/or the service providers are proof of the orders placed by the user. Data on a computer or electronic medium constitute valid proof and, as such, are admissible under the same conditions and with the same probative force as any document drawn up, received or kept in writing. Acceptance of these general terms and conditions and of the booking request constitutes an electronic signature which has the same value between the parties as a handwritten signature.
Right of withdrawal
The user is informed that, in application of article L. 121-20-4 of the French Consumer Code, all the services offered on the KE-booking platform on behalf of the service providers are not subject to the application of the right of withdrawal provided for in articles L. 121-20 et seq. of the French Consumer Code concerning distance selling. Consequently, the services ordered on the booking space are subject exclusively to the cancellation conditions set out herein and/or in the applicable Special Conditions.
Prices and payment
All the prices of the services communicated in the booking area are given in Euros, inclusive of tax and exclusive of local and tourist tax. The tourist tax levied by the local authority is set by the latter and must be paid directly to the vendor if applicable. The prices shown in the booking area may be changed at any time without notice. These changes do not apply to bookings that have already been confirmed. Payment for services ordered by the user from the service providers via the booking area is made to KE-booking on behalf of the service providers. When the order is placed, the user communicates his/her bank details using the Caisse d’Epargne secure payment system. Only payments by Carte Bleue, Visa and Eurocard/Mastercard bank cards are accepted. Depending on the service provider, the order may be settled in one of the following ways: A credit card imprint and payment of the total cost of the holiday with the service provider. A deposit by credit card and payment of the balance at the service provider’s office.
Security of your bank details
KE-booking uses the latest technology to ensure that its online payment system is as reliable as possible. The confidentiality of information is guaranteed and secured by an HTTPS protocol. Bank details are only collected by our partner, the Caisse d’Epargne, which systematically checks the validity of access rights during payment and encrypts all exchanges. Our procedures comply with PCI DSS and 3D secure standards. The system accepts CB, VISA and MASTERCARD cards.
Obligations and responsibilities of KE-booking
KE-booking acts exclusively in the name and on behalf of the service providers for all the services offered. The user acknowledges that KE-booking acts as a simple intermediary. KE-booking cannot, under any circumstances, be held responsible for service contracts that the user has concluded with one or more service providers. All the services offered are not part of the tourist package resulting from a combination put together by KE-booking. All photos representing places of accommodation and/or activities are provided under the sole responsibility of the service provider and only give an overview of the services offered. KE-booking , KAMYAB-editions and the service providers are the exclusive holders of all intellectual property rights on the site and its content (texts, photographs, illustrations, images, logos, etc.). The content reproduced on the sites is subject to copyright and its reproduction or distribution, without the express written authorisation of KE-booking, constitutes an infringement punishable by law. The offender is liable to civil and criminal penalties and in particular to the penalties set out in articles L. 335.2 and L. 343.1 of the French Intellectual Property Code. KE-booking makes every effort to satisfy the users of its service to the best of its ability but cannot be held responsible in the event of: anomalies, errors and/or bugs likely to affect navigation on the booking area or the implementation of any functionality offered on the booking area as well as the impossibility of correcting these anomalies, errors or bugs. In any case, KE-booking cannot be held responsible for any damage (direct or indirect and/or immaterial, foreseeable or unforeseeable including loss of profits or loss of a chance…) that may arise from the supply and/or use or total or partial impossibility of using the functionalities of the booking area. The user declares that he/she is aware of the characteristics and limitations of the Internet (in particular its technical performance, response times for consulting, querying or transferring data and the risks associated with the security of communications).
Obligations of the user
Any non-payment by the user, whether in full or in part, will result in the suspension of the performance of the service(s), the resulting costs being borne by the user, without prejudice to any action that may be taken against him/her.
Insurance
No insurance is included in the prices quoted in the booking area. The user is therefore advised to take out an insurance policy covering the consequences of certain cases of cancellation and an assistance policy covering certain specific risks, in particular repatriation costs in the event of accident or illness.
Protection of user data
In accordance with the French Data Protection Act of 6 January 1978, amended by Act 2004-801 of 6 August 2004, users have the right to access, modify, rectify and delete any data concerning them at any time. This right may be exercised by using the contact form on the www.ke-booking.com website or by sending a letter to KAMYAB-EDITIONS, 33 rue du maquis de Chambarand, 38210 Tullins, France, subject to proof of identity. The reservation space is regularly declared to the CNIL, under the number. The information communicated by the user in the booking area is used to process and execute their orders. This information is essential and compulsory in the booking area pages. By making a reservation via our service, you agree to receive an e-mail that we may send you after the end of your stay, inviting you to complete our customer feedback questionnaire. KE-booking may send the user information enabling them to get to know and use its sites better, as well as proposing offers from their service providers, in strict compliance with the provisions of the law “for confidence in the digital economy” and the amended “data protection and civil liberties” law, subject to the user’s prior consent. An unpaid order due to fraudulent use of a bank card will result in the registration of the details relating to the order of the user who is at the origin of this unpaid order in a payment incident file set up by the bank used and placed under its responsibility.
Complaints department
All requests for information, clarification and possible complaints must be addressed to KAMYAB-EDITIONS, 33 rue du maquis de Chambarand, 38210 Tullins, which collects them in the name and on behalf of the service providers, within 30 days following the end of the stay: – Either by registered letter with acknowledgement of receipt – Or by using the contact form on the website www.ke-booking.com No claims will be accepted for loss(es), damage(es) or theft(s) of luggage, clothing or personal items placed under the supervision of the user during the stay.
Applicable law
The General Terms and Conditions are governed by French law. In the event of a dispute that cannot be settled amicably, the French courts shall have sole jurisdiction. Should any provision of the General Terms and Conditions be declared null and void or ineffective, that provision shall be deemed unwritten, without affecting the validity of the other provisions, unless the provision declared null and void or ineffective was essential and decisive. Any case of force majeure suspends the obligations hereunder affected by the case of force majeure. It exempts the party who should have performed the obligation thus affected from any liability.
